Kingdom of Hawai‘i Laws in Force as of 1893
1. Civil Code of the Hawaiian Islands (Compiled Laws of 1884)
This code was the principal body of civil law governing:
Property rights and conveyances
Marriage, family, and inheritance
Contracts and commerce
Public administration and taxation
Rights and obligations of subjects and foreigners under the Crown
2. Penal Code of the Hawaiian Islands
Defined crimes such as treason, theft, assault, and fraud.
Set forth punishments and judicial procedures under the authority of the Crown and Judiciary.
3. Session Laws of 1884 and 1886
Amended and updated specific civil and administrative provisions of the 1884 Civil Code.
Included legislation related to land management, taxation, and court procedures.
4. The Constitution of the Hawaiian Kingdom (1864)
Remained the supreme law of the realm.
Established the powers of the monarch, legislature, judiciary, and ministers.
Affirmed the equality of all subjects before the law and the independence of the Kingdom as a sovereign State.
5. The Laws of Nations (International Law)
Applied to the Kingdom’s foreign relations and protected the rights of foreign residents under treaty.
Obligated all persons within Hawaiian territory to observe Hawaiian law, except diplomats covered under international immunity.
Proclamation by the Hawaiian Regent (1997 Confirmation)
As reaffirmed by the Regent of the Hawaiian Kingdom, Dr. David Keanu Sai, on February 28, 1997, and recorded in the Hawaiian Royal Commission of Inquiry:
“The Civil Code of the Hawaiian Islands as noted in the Compiled Laws of 1884, together with the Session Laws of 1884 and 1886 and the Hawaiian Penal Code are in full force.
All Hawaiian laws and Constitutional principles not consistent herewith are void and without effect.”
He further declared:
“The laws are obligatory upon all persons, whether subjects of this Kingdom, or citizens or subjects of any foreign State, while within the limits of this Kingdom.”
